Holiday Illness Compensation

Mrs Reid from Yorkshire, was hospitalised in the Dominican Republic having fallen victim to a debilitating holiday illness bug whilst staying at the Iberostar Costa Dorada.

Whilst in hospital in the Dominican Republic, Mrs Reid was placed on an intravenous drip and given the anti-biotic, Ciprofloxacin – a drug normally given to treat bacterial infections. Our client’s husband, Mr Reid, similarly contracted a holiday illness bug and an ear infection albeit his symptoms were far less severe.

How Mrs Reid Made a Claim...

After returning to the UK, Joanne Reid contacted Simpson Millar’s Holiday Illness team for advice on how to pursue a compensation claim against her tour operator, First Choice Holidays.

Simon Lomax, the firm’s Holiday Accident and Illness Manager made a successful claim of £13000 against First Choice, albeit the tour operator had denied liability in the first instance and put forward a robust defence. He said:

Illness Bug Abroad?

Holiday Hotel Watch

“Despite First Choice Holidays fighting tooth and nail to avoid compensating Mrs Reid for her horrific experience at the Iberostar Costa Dorada in the Dominican Republic, they finally yielded and agreed to pay the sum of £13,000

“The symptoms she suffered and the treatment she received was indicative of a bacterial food-borne bug, although this was never admitted by the tour operator.”

“Indeed, First Choice initially stated that our client’s illness bug could have been a virus or caused by change of temperature, food allergies or improper diet – inferring that she over indulged on food or binged on alcohol!”

“They continued to claim that her holiday illness bug could have been any one of the following:

‘Adenvirus, Astrovirus, Bacillus spp, Botulism, Calicivirus, Camplylobacter, Cholera, Clostridium, Perfringens, Cryptosporidium, E Coli, Entramoeba histolytica, Giardia, Helicobacter pylori, Listeria, Norovirus, Paratyphoid, Rotavirus, Salmonella, Shigella, Typhoid, and Yersina’

and it was for Simpson Millar to prove which one had caused her hospitalisation and that the standards of hygiene at the Iberostar Costa Dorada fell short of those expected in the Dominican Republic!”

Dedicated Service

Mrs Reid was impressed with the service she received from Simpson Millar’s Holiday Illness Team. When asked to sum up the service she obtained from our firm she said;

“The team that dealt with my case were fantastic – caring, on the ball, efficient, professional and much more. Simon Lomax was fantastic and so were other team members.”

Simon Lomax was excellent. I know he is a busy man yet he always made me feel my case was important – he showed compassion, professional, and his help, support and advice was extremely helpful.”

“I would have no doubts about coming back to your company again and I would certainly recommend them.”

Unlike other lawyers Simpson Millar’s Holiday Illness Solicitors promise to limit their fees to whatever we recover from the holiday company at the end of the case.

In Mrs Reid’s case, our Holiday Illness Team successfully recovered £13000 in compensation, and she received every penny of the compensation she was offered by First Choice for the holiday illness she suffered at the Iberostar Costa Dorada.

Unfortunately this popular destination remains an illness hot spot – once nicknamed the Septic Isle – because tour operators find it difficult to monitor and maintain hygiene standards on the island.
