First Choice Pay £17,500 Compensation for Holiday Village Salmonella Bug


Simpson Millar, Specialist Travel Lawyers, have made yet another successful compensation claim amounting to £17,500 for a family who suffered from salmonella food poisoning and Rota Virus whilst staying at the Holiday Village Turkey in 2011.

After returning to the UK, Mrs M. from Clydebank in Scotland contacted Simpson Millar’s Travel Lawyers having been diagnosed with Salmonella poisoning. Her young son was also diagnosed with Rota Virus following a visit to their GP.

Salmonella Food Poisoning

Salmonella are bacteria which often contaminates food causing profuse and watery diarrhoea, stomach cramps, blood in stools and occasional vomiting. The bug is killed by cooking food properly and is prevented from multiplying through hygienic food practices.

Our clients had chosen to stay at the Holiday Village because it was geared towards families. However, on arrival they were presented with a cot for their child stained with vomit and a dirty hotel room.

The holiday turned into a nightmare when the illness struck and the family was largely confined to their room for long periods.

First Choice Holiday Complaints Response

"We first approached First Choice’s legal team in May 2011 regarding this Holiday Village Turkey complaint. It took them a month to acknowledge our letter of claim and then they insisted on a further 6 months to investigate!"

"When First Choice finally responded to the claim they robustly denied liability on the basis that it was for 'the Claimant to prove that the Hotel and/or its staff failed to exercise reasonable skill and care, and that the standard of care owned falls to be assessed by reference to local standards, not British safety standards.'

They continued to say that, 'the hotel had a reasonable system of monitoring the health and hygiene of food and preparation areas on a daily basis' and that the 'hotel employs an independent Food Engineer Nilgun Kazandere who monitors not only the food and preparation areas but also the staff areas.'"

"Despite the protestations of the lawyer representing First Choice, Simpson Millar, obtained a medical report from a gastroenterologist which suggested that their gastrointestinal illnesses, including the confirmed salmonella was acquired at the Holiday Village."

"Infection from salmonella is preventable, and it is hoped that hygiene standards at the Holiday Village in Turkey have been improved for Summer 2012."
