Holidaymaker awarded £8,000 damages after slipping on wet steps near hotel pool

A British holidaymaker has been awarded compensation following a personal injury at a Turkish hotel in 2011.

When the accident occurred the teaching assistant was with her husband at the Riviera Guler Hotel, Bodrum.

Hurt after just 4 days

4 days after the couple's arrival, our client was descending steps to the lavatory from the pool area when her foot slipped and she fell.

The steps had been covered with matting to prevent hotel guests from slipping on water splashed up from the nearby swimming pool.

However, since the material had been insecurely attached to the steps, it constituted a hazard for anyone using them.

Liability was with agent

The couple had booked their all-inclusive 7-night holiday with TUI (UK) Ltd.

"Clearly this oversight by the hotel management contributed to our client's injury, as well as ruining her holiday," Simpson Millar's Paul Stevens said. "Because the holiday was an all-inclusive package, liability for the incident fell to the UK agent TUI."

18 breaches of current legislation

On behalf of the injured holidaymaker we wrote to the travel firm citing 18 breaches of Package Travel Regulations 1992, which bind UK representatives of overseas hotels to a duty of care for their all-in customers.

"The consequences of the accident for our client were a fractured left cuboid and sustained ligament and tissue damage," Paul noted.

"Our client, who was treated both locally and at home in the UK, also experienced a hypotensive attack. She was on crutches for 3 weeks and unable to work."

Poor hygiene

The claimant also made a number of complaints about alleged poor hygiene at the hotel. "There were cats in the restaurant, the hotel was dirty and it did not live up to its promised 4-star platinum standard," Paul said.

"Even when measures are taken by the hotel to prevent guests' injuries, such the matting over the steps in this case, they're clearly of little use if they are not properly implemented."
