A couple from Huddersfield have received more than £5000 compensation from their holiday company due to food poisoning caused by Shigella and Campylobacter while on holiday at the Medina Gardens in Morocco.
The couple were represented by Simpson Millar LLP to help them pursue a claim against TUI UK Limited, the tour operator that owns Thomson and First Choice.
Just a few days into their 7 night all-inclusive holiday the hotel guests concerned suffered from symptoms of vomiting diarrhoea and vomiting. The symptoms were unrelenting for the remainder of the holiday and continued after they returned home
When they returned to the UK one of them consulted their doctor about the illness who arranged for a stool sample to be taken. The results showed he had tested positive for not one, but two completely different bugs - Shigella and Campylobacter
Shigella is a travel sickness bug that is typically associated with water that has been infected with human faeces. Commonly caught from contaminated ice and fruit and vegetables that have been washed in untreated water.
Campylobacter is a type of food poisoning associated with contaminated meat and poultry that has not been cooked through properly or has been left standing at room temperatures for long periods.
Simpson Millar were able to help the couple pursue claims for the food poisoning under 1992 Package Holiday Regulations with assistance through the couple’s own observations about food hygiene practices including:
The couple both received separate compensation awards for their food and water poisoning that was well in excess of the cost of the holiday.
Upon receipt of their compensation the couple heaped praise their law firm, in particular the advice provided by Paul Stevens, Group Holiday Litigation Manager at Simpson Millar, by stating that Paul was "Very thorough and sympathetic when responding to any queries or concerns".
