Reports of sickness bugs causing diarrhoea - our Travel Law team dealing with illness compensation claims

Hotel guests enjoying their annual summer holidays have had their holidays ruined when they have been struck down with sickness causing them to be confined to their rooms and seek further treatment upon their return to the UK.

In June of last year Simpson Millar were instructed to represent a group of people that had suffered sickness and diarrhoea at the same hotel in claims against Thomson - the tour operator that sold the holiday. One client from Staffordshire was so unwell the onsite doctor placed the father from Leek on a drip.

Simpson Millar are now assisting clients that have suffered similar sickness at the Coral Sea Aqua Club this year.

The five star hotel is well known for its waterpark that features a “bowl slide” and a “lazy river”. The hotel also features two large swimming pools along with buffet and a la carte dining facilities.

Paul Stevens, Simpson Millar’s Group Illness Claims Manager, advised:

"The people that we are representing that travelled to the hotel last year expressed concerns over the cleanliness of the swimming pool and associated toilet facilities."

Food & Hygiene Concerns

Our clients advised that they were served with chicken and burgers that were still pink

"One therefore hopes that there has not been a repeat of any problems that could give rise to the kind of gastric illness we are now receiving reports about."

Paul Stevens, Simpson Millar Solicitors

"Holidaymakers that have suffered illness should give serious consideration to taking legal action against their tour operator. This is because where standards of hygiene have slipped at an overseas hotel and resulted in illness, legislation enables consumers to sue their travel agent in the UK."

Advice to Holidaymakers with Sickness Bug

Those experiencing serious sickness and diarrhoea at Coral Sea Aqua Club are urged to take the following measures:

  1. Seek medical attention as soon as possible
  2. Make sure you take advice over what precautions to take such as keeping hydrated and consuming the right types of food to reduce the extent of symptoms
  3. Gather any evidence of questionable hygiene standards - such as photographs of birds or flies in the restaurant, cold and hot food not being stored properly
  4. If you are still experiencing sickness upon your return to the UK, contact your GP
  5. Seek legal advice about making a claim against your tour operator
  6. Obtain contact details of hotel guests that have suffered similar infections
