Holiday Illness Claims

Red Sea Holiday Village, Jaz Mirabel, Club Tropicana, Coral Sea Waterworld - will you be the next victim of food poisoning?

Holidaymakers who experience food poisoning abroad often do not complain or seek compensation because they feel the cause of their illness is too difficult to prove.

If your hard earned holiday was spoilt by sickness, call Simpson Millar LLP Solicitors for advice on making a claim against your tour operator. Food poisoning is preventable and holiday companies have an obligation to ensure that the food served at the hotels they provide is fit for human consumption.

Egypt Food poisoning complaint

After all a large proportion of family earnings are spent on annual holidays and an ever increasing amount of holidays sold are all inclusive. The travel industry should demand that the hotels they sell serve food hygienically – if not they you could make a personal injury claim to obtain compensation for food or water poisoning.

Don’t be disappointed - use experienced and sympathetic travel solicitors

It is our belief that it is the responsibility of tour operators to ensure that hotels maintain a high standard of hygiene to protect the British public from food poisoning. The 1992 Package Travel Regulations enable you to claim compensation in the UK, but complex issues can arise particularly in relation to the standard care abroad and cause.

Symptoms of food poisoning

The symptoms, incubation period and duration of illness vary with the different types of food poisoning bacteria and we use this information to prove a link between the hotel and food you have consumed. Unfortunately, the symptoms of food poisoning can have a devastating effect on your ability to enjoy a holiday. They can last for days, if not months, and could include headaches, nausea, abdominal cramps, diarrhoea and fever.

Understand the dangers of food improperly handled, stored or prepared

Food poisoning bacteria do not affect the taste, smell or appearance of food. There is no way you can tell whether the food is contaminated and will cause illness without costly testing.

The illness can severely affect the very young, the elderly, the weak and the infirm causing rapid dehydration. If this occurs and your tour operator or its hotel supplier is found to be negligent then your claim for compensation is likely to succeed.

Common causes of food poisoning in Egypt

Simon Lomax, Simpson Millar LLP’s Holiday Illness Manager highlights what he believes are the 7 main causes of food poisoning:

  1. Poor personal hygiene of food handlers who often live in unsanitary conditions yet work in 4/5 star hotels
  2. Intestinal upsets of local food handlers who often carry bugs such as salmonella, e.coli and campylobacter
  3. Inadequate temperature control during the transport, preparation storage or serving of food
  4. Food from disreputable source
  5. Poor food handling practices, i.e. cross contamination of cooked with raw produce
  6. Dirty food premises, work surfaces etc.
  7. The presence of flies, cockroaches and rats

Theses causes are a breeding ground for bacteria which multiples to levels which can cause large outbreaks and severe illness to holidaymakers.

Did you experience E.coli or Salmonella food poisoning during your holiday in Egypt?

Food poisoning sickness due to Egypt restaurant

E.coli and salmonella are two of the most common types of food poisoning affected UK travellers to Egypt.

Poor personal hygiene amongst food handlers in Egypt is believed to be a common cause of illness from salmonella and e.coli. Faecal contamination of hands can be transferred to the foods or surfaces in contact with food. Convalescent carriers excrete salmonella and e.coli in their faeces for up to 12 months after their symptoms have resolved.

If Egyptian hotels were operating a HACCP (Hazardous Analysis Critical Control Points) food safety symptom, many of the hundreds of claims against them would not arise.

At Simpson Millar LLP our travel lawyers specialise in such claims and have successfully handled hundreds if not thousands of such claims personally. We are currently handling claims involving the Red Sea Holiday Village, Jaz Mirabel, Club Tropicana, Coral Sea Waterworld and many others.

Most of our expert holiday lawyers have over 10 years of experience handling food poisoning claims and for both sides pursuing claims and defending tour operators. The fact that we have held management positions in the UK’s major holiday companies provides us an insight of the industry and an advantage over other solicitors practicing in this niche area of law.
