Thomas Cook Admits Liability for Shigella Illness Le Royal Holiday Park in Egypt

The UK’s second largest tour operator Thomas Cook has accepted responsibility for a Carlisle family’s nightmare holiday at the Le Royal Holiday Park Hotel in Egypt. The holiday was curtailed following severe bouts of infective gastroenteritis, the resultant illness causing distress and discomfort to the party.

The family holiday was ruined by the bacterial infection, Shigella, which Simpson Millar’s travel lawyers alleged was caused by food poisoning at the Le Royal.

Simon Lomax, Simpson Millar’s, Holiday Illness Claims manager said:

“Bacillary dysentery is caused by a bacterium called Shigella. It is spread by the faecal-oral route and is a common cause of illness amongst travellers staying in Egypt. The disease can be water-borne or food borne, but we strongly suspect that this infection came from the food served due to the hygiene concerns report by my client.”

“The infection was confirmed following stool cultures taken on their return to the UK.”

“As a consequence of this diagnosis we alleged that:

  • The Hotel was not of the advertised standard;
  • Staff failed to institute, monitor or enforce any or any reasonable system of food hygiene;
  • The Hotel failed to cook food properly and left it uncovered and exposed to flies for long periods; and
  • The Le Royal Holiday Park failed to exercise reasonable skill and care to ensure the elimination of any risk of food poisoning from the food and drink served.

Thomas Cook has admitted improper performance of the contract and agreed to compensate our clients subject to the provision of medical reports.”

Holidaymakers who experience dysentery whilst on holiday with Thomas Cook are able to claim compensation pursuant to powerful consumer protection laws - the 1992 Package Travel Regulations. It is anticipated that this Shigella food poisoning claim will warrant substantial compensation.
