Holiday Illness Complaint

Sick on holiday in the Dominican Republic, Mexico or Cuba?

Due to the thousands of holiday makers having to avoid Egypt for their holiday due to the security concerns around Sharm el Sheikh Airport, people seeking winter sunshine have been forced to look further afield this year and are choosing destinations such as Cuba, Mexico and the Dominican Republic.

As a consequence of all of this, Simpson Millar has seen a significant increase in enquiries and instructions from people wanting to claim compensation against their tour operator - for serious bouts of food poisoning in long haul destinations in and around the Caribbean.

Diarrhoea often caused by lapses in hygiene standards

In contrast to what the tour operators would have you believe - that sickness bugs are caused by too much sun and alcohol - serious bouts of traveller’s diarrhoea will often be caused by lapses in hygiene standards - and for those staying at all-inclusive hotels, the hotel buffet is often the most likely cause.

Sickness on holiday complaint

For example, a man from Scarborough has recently instructed Simpson Millar to help him claim against Thomas Cook for a sickness bug suffered at the Sol Rio De Luna Y Mares hotel in Cuba. Returning from the hotel in January of this year, amongst his many concerns were the presence of birds and cockroaches around the hotel restaurant and service of food at lukewarm temperatures.

Salmonella and campylobacter concerns

While they may appear harmless, birds seen landing and pecking away at buffet food can spread harmful germs such as salmonella and campylobacter. If food is not kept hot, the rate at which bugs will multiply will rapidly increase.

We have just been instructed to help a group of holidaymakers claim compensation against TUI UK for sickness suffered at the Akumal Bay Beach hotel in Cancun Mexico. Amongst the multiple complaints were reports of hot food that was never served “hot” and cold food being inadequately refrigerated?

We are also helping people who have suffered sickness bugs at the Iberostar Punta Cana in the Dominican Republic. Based on the accounts from Tripadvisor the problem seems to be on going.

Claiming compensation for sickness on holiday

Compensation for sickness bugs for long haul destinations will inevitably be a lot higher than the cheaper short hall destinations owing to the difference in holiday cost. A lot will depend on the duration and severity of symptoms although most settlements with tour operators tend to exceed £2500 per person.
