We have recently been contacted by a disappointed holidaymaker who has informed us that they suffered the symptoms of a Salmonella infection while staying at the Hotel Playa Pesquero, where they say that they were served food that wasn't as hot as they believe it should have been.
The Hotel Playa Pesquero is advertised by Thomas Cook, a tour operator who are currently based in the UK, who sell all-inclusive packages to the resort to British tourists looking to travel to the increasingly popular Holguin region of Cuba. The hotel has a range of facilities and restaurants, but recently we have been contacted by a guest who says that they contacted Salmonella during their stay.
This is not the first time that we have received reports of holiday illness at the Playa Pesquero. Since 2014 we have represented numerous clients that have suffered similar illness at the hotel, one of whom suffered from a harmful strain of E. coli (or VTEC) during their stay. In recent months, we have written about other guests who have also reported illness; once in January and again in February.
The sick holidaymaker has informed us that they stayed at the Playa Pesquero between February and March of this year, and they say that they were served a variety of high-risk produce such as chicken and eggs that did not appear to be as hot as they believe that they should have been.
They advised us that halfway through their stay at the Playa Pesquero, they began to experience the tell-tale symptoms of a gastric illness, including painful stomach cramps and diarrhoea, as well as feeling faint during the acute stage of their illness.
Understandably, this has put quite a dampener on their hard earned break abroad, and after approaching medical professionals abroad and in the UK for a diagnosis and treatment, they have been informed that they contracted the Salmonella bacteria; a disease that is commonly associated with food poisoning.
They say that while they suffering the acute symptoms of their illness, they were unable to request help with their condition from a Thomas Cook representative at the Hotel Playa Pesquero.
Salmonellosis is the name of the condition caused by the Salmonella bacteria which can be caused by food poisoning. Salmonella can be contracted through environmental factors, and there are reports of Salmonellosis being caused by problems with poor hygiene, but in our experience, it is more often that case that it has been caused by raw or undercooked high risk produce such as chicken and eggs.
Meat, such as chicken, needs to be cooked thoroughly to eradicate not just Salmonella, but other potentially harmful forms of bacteria such as E. coli and Campylobacter. Because of this, if you are served chicken in a hotel restaurant, it's generally advisable to cut into it first to make sure that it isn't pink in the middle. If it is and you take a bite before you realise, your enjoyment of your holiday could come crashing to a halt.
The holiday ruining symptoms of Salmonella can include a sensation of nausea, as well as vomiting, stomach cramps, diarrhoea, a fever or chill, headaches and blood in your stool. In some instances, a Salmonella infection can result in further health complications, including long-term conditions such as Irritable Bowel Syndrome (IBS), so it's vital to receive treatment as soon as possible.
If you've suffered the symptoms of a gastric illness or you've received a diagnosis for a food poisoning pathogen after staying at an all-inclusive hotel on a package holiday, then you might be able to claim compensation from your tour operator.
This is because of The Package Travel Regulations 1992 and the contract that you hold with your tour operator. This regulation essentially places responsibility on your tour operator to take reasonable steps to prevent you from coming to harm on your holiday, and this includes ensuring that you don't suffer food poisoning from inadequately cooked food at an all-inclusive restaurant.
If they fail to do this, they could be seen as being in breach of their contract with you, and this is why you're able to claim compensation.
