The Tour Operator has forced us to upgrade
The hotel that you had originally booked is full, so the Tour Operator arranges for you to stay in a different, more expensive, hotel. You are forced to pay the increase in price. Can the Tour Operator do this?
The Package Travel Regulations 1992 state that the Tour Operator is responsible for the actions of the hotel owner and so has to organise “suitable alternative arrangements for the continuation of the package.” The holidaymaker should not incur any extra cost, so if the new hotel is more expensive then the Tour Operator must cover the additional cost. The holidaymaker should claim any extra money incurred back from the Tour Operator. A claim can also be made for any loss of enjoyment suffered whilst sorting out changing hotels.
